Terms and Conditions for Rental of Off-Road Personal Recreation Vehicles

Please Read These Terms and Conditions Carefully Before Booking or Operating a Vehicle from Bug-Out Bikes LLC.
By accessing, Browse, making a reservation, entering into a rental agreement, or operating any vehicle provided by Bug-Out Bikes LLC (referred to herein as "Bug-Out Bikes," "we," "us," or "our"), you ("Renter," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Refund Policy, our Privacy Policy, and any separate Waiver of Liability and Rental Agreement you may sign. If you do not agree to these terms, you may not rent or operate our vehicles.
1. Definitions

Bug-Out Bikes LLC (Lessor): Refers to Bug-Out Bikes LLC, the owner and provider of the Rental Vehicles.

Renter (Lessee): Refers to the individual or entity making the booking, signing the Rental Agreement, and/or operating the Rental Vehicle.

Rental Vehicle (Vehicle / OHV / ATV / UTV): Refers to the specific off-road personal recreation vehicle (including, but not limited to, Motorcycles, Dirt bikes, ATVs, UTVs/Side-by-Sides) rented from Bug-Out Bikes, including all its parts, components, accessories, safety gear, and accompanying equipment.

Rental Period: The agreed-upon duration for which the Rental Vehicle is rented, starting from the scheduled pick-up time and ending at the scheduled return time.

Authorized Driver: Any person designated and approved by Bug-Out Bikes who meets all eligibility requirements and is authorized to operate the Rental Vehicle under this Agreement.

Charges: All fees, costs, expenses, and penalties incurred by the Renter under this Agreement, including rental rates, deposits, late fees, cleaning fees, damage charges, and recovery fees.

Loss of Use: The loss of Bug-Out Bikes' ability to rent the damaged Rental Vehicle while it is being repaired or is unavailable due to damage or an incident.
2. Eligibility and Rental Requirements
To rent and operate a Rental Vehicle from Bug-Out Bikes, the Renter and all Authorized Drivers must meet the following mandatory requirements:

Age: The primary Renter must be at least 25 years old. All Authorized Drivers must be at least 16 years old (or as required by Utah State law for specific vehicle types, if different, and must comply with those laws).

Valid Driver's License: Possess a valid, unexpired, government-issued driver's license from the United States or an international equivalent. The license must not be suspended, revoked, or otherwise restricted.

OHV Education Course: All operators born after December 31, 1987, must have successfully completed the Utah Off-Highway Vehicle (OHV) Education Course and possess a valid OHV Education Certificate. Proof of completion may be required at pick-up.

Credit Card: Provide a valid credit card in the primary Renter's name for payment and security deposit. Debit cards may not be accepted for the security deposit.

Physical and Mental Fitness: Be physically and mentally capable of safely operating an off-road vehicle. Bug-Out Bikes reserves the right to deny rental if there is any doubt regarding the Renter's or Authorized Driver's ability to operate the vehicle safely.

Acknowledge and Agree: Understand and explicitly agree to all terms outlined in this document, the Refund Policy, Privacy Policy, and the separately signed Waiver of Liability and Rental Agreement.
3. Booking, Payment, and Charges

Booking Confirmation: A booking is considered confirmed only upon receipt of full payment and Bug-Out Bikes' confirmation.

Rental Rates: All rental rates are as displayed on our website or quoted by our staff at the time of booking. Rates are subject to change without prior notice, but confirmed bookings will honor the agreed-upon rate.

Payment: Full payment for the rental period is due at the time of booking.

Additional Charges: The Renter agrees to pay all applicable Charges, including but not limited to:

Late Return Fees: Rental Vehicles returned after the agreed-upon return time will incur a late fee of [$7 per hour, up to a maximum of a full day's rental rate for every 24-hour period (or portion thereof) the vehicle is late. This is crucial for timely turnover for other customers.

Cleaning Fees: Rental Vehicles returned in an excessively dirty condition (e.g., heavily caked with mud, food waste, or unusual debris beyond normal trail dust/mud) will be subject to a cleaning fee of $40-$135 depending on severity.

Fuel Charges: Rental Vehicles are provided with a full tank of fuel. Renters must return the vehicle with a full tank. Vehicles returned with less than a full tank will be subject to a refueling charge of $4 per gallon plus a $8 service fee.

Recovery/Extraction Fees: In the event a vehicle becomes stuck, incapacitated, or runs out of fuel in a remote location due to Renter's negligence, misuse, or failure to follow safety guidelines, the Renter will be responsible for all costs associated with vehicle recovery/extraction, including personnel, equipment, and any resulting damages to the vehicle or recovery equipment. Fees can range from $75 - $2000 depending on location and complexity.

Damage Charges: Costs associated with damage to the Rental Vehicle, its parts, accessories, or equipment (see Section 8).

Traffic Violations/Fines: Any traffic citations, parking tickets, tolls, or other fines incurred during the Rental Period are the sole responsibility of the Renter. An administrative fee of $35 will be charged for processing such violations.

4. Security Deposit
A security deposit of $20 - $500 is required at the time of pick-up. This deposit will be processed as a pre-authorized hold on your credit card. The security deposit is held to cover potential damages, late return fees, cleaning fees, recovery fees, or any other outstanding charges incurred during the Rental Period. The full security deposit will be released within 5-7 business days after the Rental Vehicle is returned on time, in good condition (less normal wear and tear), and with a full fuel tank, provided no additional charges are applicable. Any charges against the deposit will be deducted before release. If damages exceed the deposit amount, the Renter agrees to pay the additional costs.
5. Cancellation and Refund Policy
Our Cancellation and Refund Policy is an integral part of these Terms and Conditions. Please review it separately for details regarding full, partial, and no-refund scenarios. 6. Rental Period
The Rental Period begins at the scheduled pick-up time and ends at the scheduled return time. Renters must return the vehicle promptly at the agreed-upon time and location. Any request for extension of the Rental Period must be approved by Bug-Out Bikes in advance and is subject to vehicle availability and additional charges. Unauthorized extensions will result in late fees and potential forfeiture of the security deposit.
7. Vehicle Condition and Inspection

Pre-Rental Inspection: Upon pick-up, the Renter is required to thoroughly inspect the Rental Vehicle for any pre-existing damage, including but not limited to scratches, dents, mechanical issues, or missing parts. Any existing damage must be immediately reported to Bug-Out Bikes staff and documented on the Rental Agreement. Failure to report existing damage prior to departure will result in the Renter being held responsible for such damage.

Return Condition: The Renter agrees to return the Rental Vehicle in the same condition as it was received, excluding normal wear and tear. All accessories, safety gear, and equipment provided must be returned.

Post-Rental Inspection: Upon return, Bug-Out Bikes staff will conduct a final inspection. Any new damage, excessive dirt, or missing items will be noted, and associated charges will be assessed against the security deposit or charged to the Renter.
8. Authorized Use and Restrictions
The Renter and all Authorized Drivers agree to operate the Rental Vehicle strictly in accordance with these Terms and Conditions, all applicable laws, and safe operating practices. Any violation of these restrictions will result in immediate termination of the rental agreement, forfeiture of all rental fees and security deposit, and potential legal action.

Designated Trails Only: Rental Vehicles are strictly permitted for use only on designated 50-inch ATV trails and other legal, marked OHV trails in Utah.

Prohibited Areas: Operation is strictly prohibited in:

Private property without express written permission.
-
Environmentally sensitive areas (e.g., wetlands, fragile ecosystems).
-
Paved or public roads, highways, or interstates unless specifically designated and marked for OHV use and legal under Utah law.

Closed areas, restricted areas, or any area marked "no trespassing."
-
Water crossings exceeding [e.g., 12 inches / manufacturer's specified water depth] depth.

Any area that would cause excessive environmental damage or violate local ordinances.

Prohibited Activities:
-
No Reckless Driving: Stunting, racing, jumping, drifting, or operating the vehicle in a reckless or negligent manner that endangers persons or property.

No Impaired Operation: Operating the vehicle under the influence of alcohol, drugs, or any substance that impairs judgment or reaction time.

No Overloading: Exceeding the manufacturer's specified seating or weight capacity for the vehicle.

No Unauthorized Towing: Towing other vehicles or being towed by another vehicle without explicit written permission from Bug-Out Bikes.

No Unauthorized Modifications: Making any modifications, alterations, or repairs to the Rental Vehicle.

No Disabling Safety Features: Tampering with, disabling, or removing any safety devices (e.g., seat belts, roll cages, governors).

No Subleasing: Subleasing or re-renting the Rental Vehicle to any third party.

No Commercial Use: Using the vehicle for commercial purposes (e.g., tours, hauling for hire).

No Disconnecting GPS: Disconnecting, altering, or tampering with any GPS tracking devices installed on the vehicle.

Mandatory Safety Gear: All occupants must wear DOT-approved helmets at all times while the vehicle is in motion, along with any other safety gear provided or recommended by Bug-Out Bikes.

Following Instructions: Renter and all Authorized Drivers must adhere to all instructions provided by Bug-Out Bikes staff, including safety briefings and operational guidelines.
9. Renter's Responsibility for Damage, Loss, or Theft

Full Responsibility: The Renter assumes full responsibility for any and all damage to, loss of, or theft of the Rental Vehicle (including all parts, accessories, and equipment) from the moment of pick-up until its return and acceptance by Bug-Out Bikes, regardless of fault or cause (including acts of God, vandalism, fire, collision, rollover, etc.).

Cost of Damage: The Renter is responsible for the full cost of repairs to the Rental Vehicle, including parts, labor, and any applicable Loss of Use fees (calculated at the daily rental rate for each day the vehicle is out of service for repairs), up to the fair market value of the vehicle if it is deemed a total loss.

Theft: In the event of theft, the Renter is responsible for the fair market value of the vehicle.

Reporting: The Renter must immediately report any accident, damage, mechanical issue, or theft to Bug-Out Bikes at (385) 537-2777 AND to the local law enforcement agency within one hour of the incident occurring. Failure to report promptly may result in denial of any claims or increased liability. Do not attempt to repair the vehicle yourself.
10. Insurance
Bug-Out Bikes LLC DOES NOT provide primary liability or physical damage insurance for the Renter or any Authorized Driver.

Renter's Responsibility: The Renter acknowledges and agrees that they are solely responsible for securing any necessary insurance coverage for physical damage to the Rental Vehicle and for third-party liability (damage to other property or injury to other persons) arising from their use of the Rental Vehicle.

Personal Insurance: The Renter is advised to check with their personal auto insurance, homeowner's insurance, or credit card company to determine if they provide coverage for off-road vehicle rentals. Most personal policies DO NOT cover rented off-road vehicles.

Optional Damage Waiver (If Offered): If Bug-Out Bikes offers an optional Damage Waiver or similar protection plan, its terms and conditions will be outlined in a separate document. Such waivers are not insurance, may have deductibles, and typically only cover specific physical damage to Bug-Out Bikes' vehicle, often with exclusions for reckless driving, unauthorized use, or violations of these Terms and Conditions. Opting for a Damage Waiver does not absolve the Renter of liability for damages exceeding the waiver's coverage or for third-party liability.
11. Assumption of Risk and Release of Liability

Inherent Dangers: The Renter acknowledges that operating an off-road personal recreation vehicle involves inherent and unavoidable risks of serious personal injury, death, and property damage. These risks include, but are not limited to, falls, collisions, rollovers, mechanical failures, adverse weather conditions, natural hazards, terrain changes, and the actions of other riders or third parties.

Assumption of Risk: By renting and operating a Rental Vehicle, the Renter, for themselves and all Authorized Drivers and passengers, voluntarily assumes all risks associated with OHV operation, including those caused by the negligence of Bug-Out Bikes, its employees, agents, or other participants.

Release of Liability: To the fullest extent permitted by law, the Renter hereby releases, waives, discharges, and covenants not to sue Bug-Out Bikes LLC, its owners, employees, agents, affiliates, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury (including death) that may be sustained by the Renter, any Authorized Driver, any passenger, or any property, whether caused by the negligence of Bug-Out Bikes or otherwise, while participating in the rental or operation of the Rental Vehicle.

Separate Waiver: A separate, more detailed Waiver of Liability and Assumption of Risk document will be presented and must be signed by the Renter and all Authorized Drivers and adult passengers prior to taking possession of the Rental Vehicle. 12. Indemnification
The Renter agrees to indemnify, defend, and hold harmless Bug-Out Bikes LLC, its owners, employees, agents, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with: (a) the Renter's or any Authorized Driver's use or operation of the Rental Vehicle; (b) any breach of these Terms and Conditions or the Rental Agreement by the Renter or any Authorized Driver; (c) any personal injury, death, or property damage caused by the Renter's or any Authorized Driver's negligence or willful misconduct; and (d) any third-party claims arising from the rental period.
13. Privacy Policy
Your privacy is important to us. Our Privacy Policy details how we collect, use, and protect your personal information. 14. Intellectual Property
All content on the Bug-Out Bikes website, including text, graphics, logos, images, and software, is the property of Bug-Out Bikes LLC and is protected by copyright and other intellectual property laws. You may not use, reproduce, modify, or distribute any content without our express written permission.
15. Governing Law and Jurisdiction
These Terms and Conditions and any disputes arising out of or related to them or your rental shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of such courts.
16. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be severed from the rest of the agreement, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms and Conditions, together with our Refund Policy, Privacy Policy, and the specific Rental Agreement and Waiver of Liability signed by you, constitute the entire agreement between you and Bug-Out Bikes LLC concerning the rental of the Rental Vehicles and supersede all prior or contemporaneous communications, agreements, and understandings, whether electronic, oral, or written.
18. Changes to Terms
Bug-Out Bikes reserves the right to modify or update these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms and Conditions. It is your responsibility to review these terms periodically for updates.
